Terms & Conditions

These Terms govern your use of ToneWise ("the Service"), provided by ToneWise (the "Seller"). By using the Service you agree to these Terms.

1. Who you are contracting with

You are contracting with Sai Swetha Yellapragada (trading as "ToneWise"), an individual sole trader operating the Service. References to "ToneWise", "we", "us", or "Seller" in these Terms refer to Sai Swetha Yellapragada.

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms and our Privacy Notice.

3. The Service

ToneWise is an AI-assisted emotional intelligence companion that analyzes messages, conversations, voice notes, and screenshots and provides reflective insights, rewrites, and coaching content. Outputs are reflective — not therapy, medical, legal, or financial advice. You are responsible for how you act on them.

4. Acceptable use

You must not: (a) use the Service unlawfully; (b) commit fraud or send spam; (c) infringe anyone's intellectual property; (d) attempt to interfere with or probe the Service's security; (e) submit malware; (f) submit content you do not have the right to submit; (g) use the Service to harass, threaten, or harm any person.

5. AI-specific terms

You are responsible for your prompts, the inputs you submit, and how you use any output. You confirm you have the rights to any content (including screenshots and voice recordings) you submit. We may refuse, filter, or remove content and may suspend accounts that repeatedly produce or attempt to produce prohibited content. AI outputs may be inaccurate or incomplete and should not be relied on for regulated professional advice.

6. Account & credentials

You are responsible for the confidentiality of your account credentials and for activity under your account. Provide accurate information and keep it up to date.

7. Intellectual property

ToneWise and all related software, content, branding, and documentation are the property of the Seller. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan. You may not reverse engineer, resell, or redistribute the Service or circumvent its technical limits.

8. Your content

You retain ownership of content you submit. You grant us a limited license to host, process, and analyze it solely to provide the Service to you.

9. Payments, billing & subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until canceled.

10. Service availability

We do not guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features at any time.

11. Suspension & termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated/serious violations of these Terms. On termination, your right to use the Service ends and your data may be deleted after a reasonable export window.

12. Warranties & liability

To the fullest extent permitted by law, the Service is provided "as is" without implied warranties. Our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing limits liability for fraud, death, or personal injury where prohibited by law.

13. Indemnity

You agree to indemnify the Seller against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of India, the jurisdiction in which the Seller (Sai Swetha Yellapragada) is resident, without regard to conflict-of-laws rules.

15. Changes

We may update these Terms. Material changes will be communicated in the app or by email; continued use after changes means you accept them.
